1. INTRODUCTION
1.1. These Terms and Conditions (“Terms”) govern all purchases, orders, design services, and use of the website operated by Sweet Art Design Studios (Pty) Ltd (“we”, “us”, “our”).
1.2. By accessing our website, placing an order, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1.3. If you do not agree to these Terms, you must refrain from using our website and/or services.
2. DEFINITIONS
For purposes of these Terms:
2.1. “Custom / Personalised Product” refers to any product that is produced, printed, altered, or designed specifically to customer specifications.
2.2. “Artwork” includes any graphic design, mock‑ups, proofs, visual representations, or digital files supplied by us or by the customer.
2.3. “CPA” refers to the Consumer Protection Act 68 of 2008 (South Africa).
3. ORDERS AND ACCEPTANCE
3.1. Orders may be placed via email, in person, WhatsApp or online platforms.
3.2. No order is deemed accepted until payment is received in full and artwork approval is signed/confirmed by the customer.
3.3. Lead times commence only after artwork approval and full payment.
4. ARTWORK AND CUSTOMER APPROVAL
4.1. All artwork, proofs and mock‑ups must be approved in writing by the customer. Approval includes SMS, WhatsApp, email, or digital acceptance prompt on the website.
4.2. Once approved, the customer accepts that:
4.2.1. Production will begin immediately.
4.2.2. No changes may be made.
4.2.3. No cancellations, refunds, or returns will be permitted for personalised items. 4.3. We take no responsibility for errors approved by the customer.
5. PAYMENT TERMS
5.1. Payment is required in full before production or ordering of stock begins.
5.2. Prices may change without notice until payment is received.
5.3. Final invoicing may include delivery charges, outsourced production costs, or specialised materials.
6. REFUNDS, RETURNS & CANCELLATIONS (CPA COMPLIANT)
6.1. In accordance with the CPA, customised or personalised goods cannot be returned or refunded, unless defective due to workmanship.
6.2. Returns will only be considered if:
6.2.1. The product is defective due to a manufacturing fault; and
6.2.2. Notice of defect is received within 7 calendar days of delivery/collection.
6.3. Refunds will not be given for:
• Customer error (spelling, colours, content) after approval.
• Change of mind after approval.
• Incorrect sizes supplied by the customer. 6.4. In the event of a valid defect, we reserve the right to repair or replace the item before a refund is considered.
7. DELIVERY & RISK
7.1. We use third‑party couriers. Delivery time estimates are indicative only.
7.2. Once goods are collected by the courier, risk transfers to the customer.
7.3. We are not liable for: delays, loss, damage or incorrect delivery caused by courier services.
8. INTELLECTUAL PROPERTY
8.1. All designs created by us remain our intellectual property until full payment is received.
8.2. We reserve the right to use completed work for marketing purposes unless otherwise agreed in writing.
9. CUSTOMER-SUPPLIED DESIGNS & COPYRIGHT
9.1. By submitting any artwork, you warrant that you own or have obtained legal permission to use that material.
9.2. You indemnify us from any claim, liability, or damages arising from copyright infringement.
10. LIMITATION OF LIABILITY
10.1. Our liability is limited to the total invoice amount paid for the order.
10.2. We are not liable for consequential, indirect, or special damages.
11. PRIVACY AND DATA HANDLING
11.1. Personal information is collected and stored in accordance with POPIA (Protection of Personal Information Act).
11.2. We do not share customer information with third parties unless required for order fulfilment or by law.
12. GOVERNING LAW AND JURISDICTION
12.1. These Terms are governed by the laws of the Republic of South Africa.
12.2. Any disputes shall first be resolved through negotiation, failing which the matter will be referred to the appropriate court.
13. AMENDMENTS
13.1. We reserve the right to modify these Terms at any time. Updated Terms will be posted on our website.
